Types of Personal Injury Cases We Handle

Our trial attorneys handle a broad range of personal injury claims, including:

Traffic Accidents

Over a quarter of a million people are injured in Florida car accidents each year and about 3,000 of them die of their injuries. Whether you were injured as a driver, passenger or pedestrian, and whether the accident was caused by another driver’s distraction, impairment or reckless driving, we have your back. If you were injured due to a mechanical defect in one of the vehicles or by poor road maintenance, you are still a victim who deserves compensation. In any case, your talented personal injury attorney will do all that we can to see that you get it.

Construction Accidents

Construction accidents can affect construction workers who fall, are hit by heavy objects, suffer burns from explosions, or are hurt by defective equipment. Pedestrians simply walking by a construction site are also sometimes hit by falling scaffolds or debris and severely hurt. No matter whether you are a worker covered by Workers’ Compensation or a civilian covered by premises liability, Perez Mayoral can successfully pursue your personal injury claim.

Premises Liability

Our legal team will also gladly intervene if you were seriously injured because of a property owner’s negligence. Whether the property owner was an individual, company, or government entity, once we determine you have a viable case, we will file a premises liability lawsuit on your behalf. Whether you have fallen on an icy step or been bitten by the owner’s dog, we will fight aggressively to win you the damages you deserve.

Product Liability

Frequent recalls of defective or contaminated products are evidence of dangerous products that pass to unsuspecting consumers in spite of regulatory laws. If you or a loved one has had the misfortune of being harmed by a defective tool, household item, food product or medication, Perez Mayoral is here to help. Whether the harm you endured was the result of carelessness, poor supervision, or simple greed, we will do everything possible to see that you are reimbursed for your hardship.

Wrongful Death

When a personal injury leads to a fatality, it might seem that pursuing a lawsuit won’t alleviate the enormity of your loss. However, our compassionate lawyers are dedicated to ensuring that you receive fair compensation. We strive to secure a settlement that covers not only the final medical and funeral expenses but also compensates for the loss of financial and emotional support that you’ve endured due to your loved one’s untimely death.

Negligent Security

Negligent security is the lack of adequate or proper security based on the circumstances. Property owners have a duty to keep others safe from harm, including from criminal assault. Because many of these crimes could have been avoided through adequate security, if property owners fail to take adequate safety measures or to warn visitors of dangerous conditions, they can be held liable for your damages.

The type of property where your injury occurred affects the investigation we will undertake, as well as the monetary award in your claim.  We file lawsuits against the owners of the property, as well as the owner of property’s parking lot, where you or a loved one were injured.  Some of the types of properties that can be found to be liable for negligent security include:

  • Apartment Buildings and Condominium Complexes
  • Schools, Colleges, Universities, and their student dorms
  • Shopping Malls & Shopping Plazas
  • Hotels & Motels
  • RV & Trailer Parks
  • Retail Stores
  • Grocery stores
  • Pharmacies
  • Restaurants
  • Gas Stations & Convenience Stores
  • Banks and ATM’s
  • Casinos
  • Bars
  • Night clubs
  • Concert grounds
  • Concert halls
  • Sporting Arenas
  • Office Buildings
  • Nursing homes
  • Hospitals

What happens if I bear some responsibility for my own injury?

Suppose you were intoxicated when you fell into an unmarked hole on someone else’s property or were speeding when a driver making an illegal turn hit your car? Different states handle the problem of shared blame for accidents in different ways. Florida works under the principle of pure comparative negligence.

What this means is that in Florida you can still file a claim for damages even if you are partially responsible for the accident. However, the court will assign a percentage of blame to each party and you will only be able to receive damages for the amount awarded minus your percentage of blame. So, if you are awarded $100,000 and the court deems you to be 25 percent responsible for the accident, you will actually receive $75,000. In this context, the word “pure” means that you can sue even if you bear greater responsibility for the accident than the defendant.

Compensation We Will Fight to Obtain for You and Your Family

We know all too well what a difficult period you are going through — medical bills piling up while you are unable to work, looking forward to months of recovery or, possibly, long-term care. We will make every effort to help you obtain substantial compensation for:

  • Medical and rehabilitation costs
  • Lost income and lost earning power
  • Property damage or loss
  • Replacement services (e.g. house cleaning)
  • Extended nursing care
  • Pain and suffering
  • Permanent disability
  • Permanent scarring or other disfigurements
  • Loss of enjoyment of life
  • Wrongful death damages (as previously described)

If the defendant’s misconduct was especially egregious behavior, we may also be able to persuade the court to award you punitive damages.
