Erik Perez, a shareholder at Perez Mayoral, P.A., was recently interviewed by Fox 4 News to offer legal insight into a growing controversy on San Carlos Island, where homeowners still recovering from Hurricane Ian are being told to remove their RVs and trailers— despite ongoing rebuild efforts and county rules that allow them to stay through October 2027.
Several residents on Nancy Lane received notices from their condominium association setting a two-month deadline to vacate their temporary homes. The move has sparked concern from homeowners who say they rely on their trailers to supervise construction and live safely on-site during rebuilding.
In the segment, Perez was asked to explain whether Senate Bill 250 (SB 250)—a 2023 Florida law passed in response to natural disasters—protects homeowners from these types of association restrictions. His response highlighted a critical distinction: “Attempting to apply SB-250? If you take a narrow interpretation of the statute, it does not appear to provide homeowners protection against their association but rather their county or municipality,” Perez said.
SB 250 allows homeowners to use temporary structures like RVs on their property for up to 36 months after a declared state of emergency—but only restricts counties and cities from interfering. It does not prevent private condominium or HOA boards from enforcing their own rules, even during a disaster recovery period.
