Coconut Grove condo owner upset over $7.1M special assessment
Erik Perez, a Florida attorney who focuses on HOA and condominium law, was featured in a CBS News Miami report covering a high-profile dispute at The Cloisters on the Bay, a luxury condominium community in Coconut Grove.
The story highlighted the concerns of unit owner John DuBois, who received notice of a $153,000 special assessment following the board’s approval of a $7.1 million repair plan. DuBois said he was blindsided by the amount and given just two weeks to pay.
In his interview with CBS, Perez discussed how new statewide building safety laws, enacted after the Surfside condominium collapse, have triggered increased repair and inspection requirements, contributing to more frequent and costly assessments.
“We’re seeing more associations pass assessments like this to comply with the new laws,” Perez added. “And unfortunately, owners often have little say if the board follows proper procedure.”
