Michael Mayoral, shareholder at Perez Mayoral, P.A., appeared again on NBC Miami in a follow-up report addressing new Florida laws designed to increase transparency within HOAs and condominium associations. The segment focused on homeowners’ legal rights to access financial records and remove uncooperative board members.
Under Florida law, HOAs are now required to provide access to financial documents within 10 business days of a written request and maintain those records for at least seven years. Failure to comply can result in fines or even criminal liability in some cases.
In the interview, Mayoral emphasized the power homeowners have under Florida law:
“One of the most powerful things that unit owners have, both in a condominium association or HOA, is the right to recall their board. A majority vote can take out the current board and replace them with one that’s going to investigate what’s going on.”
He also reminded viewers that any action taken by the board must be tied to either a statute or the governing documents. If an HOA tells you something is not allowed, they must point to the legal authority behind it.
