Frequently Asked Questions

Your Real Estate Questions Answered
How do zoning laws affect property use?

Zoning laws are set by local governments to regulate the development and use of land. These laws can dictate the type of buildings allowed on a property, the kinds of activities that can take place, and even the height and setback of structures. If your property use doesn’t align with local zoning ordinances, you may need to apply for a variance or possibly rezone the property, both processes for which legal guidance is recommended.

What should I do if I'm facing a property lien?

A property lien can be placed on your real estate as a result of unpaid debts, whether they are related to taxes, contractors, or through court judgments. If you discover a lien on your property, it’s wise to address it promptly. You can pay off the debt, challenge the lien if it’s unwarranted, or negotiate with the creditor. Legal advice is beneficial in navigating these options to protect your property rights.

What should I know before entering a commercial lease agreement?

Before signing a commercial lease, understand all its terms thoroughly. This includes the lease duration, payment terms, what constitutes a breach of contract, and your rights as a tenant. Also, review clauses regarding property improvements, subleasing, and termination conditions. Consulting with a lawyer can help clarify these terms and ensure the lease agreement meets your business needs.

What are common reasons for real estate litigation?

Real estate litigation can commonly involve disputes over contract breaches, property defects not disclosed during the sale, boundary and title issues, and landlord-tenant disagreements. These disputes often require legal proceedings to resolve ownership, financial responsibilities, and compliance with real estate laws.

How can I resolve a real estate dispute without going to court?

Resolving disputes outside of court can often be achieved through negotiation or mediation, where a neutral third party helps both sides reach an agreement. This process can be less confrontational and more cost-effective than going to court. Arbitration is another method, where an arbitrator makes a binding decision on the dispute. Each of these alternatives requires careful preparation and understanding of the legal issues involved, which a lawyer can provide. And if these alternatives fail, our real estate litigation lawyer can help you deal with the court.

As many of us know all too well, insurance companies are in business to protect their bottom line, not your home and possessions, so adjusters are trained to lowball or deny as many homeowners’ policy claims as possible. Without the informed legal advocacy our law team provides, you are far less likely to come away with a just settlement for your property damage, even though you may have paid expensive premiums for years without ever submitting a claim.

Your experienced wind damage attorney will use their well-known negotiation and litigation skills to fight aggressively to obtain the compensation you are entitled to. We are also well-schooled in the current values of repairs, rebuilding, or replacing your home and your property. We will keep you from being taken advantage of, even if we have to go to court to do so.

When the Sunshine State Is Not Sunny, It Is Often Windy

As mentioned, South Florida is, unfortunately, prone to many storms with damaging winds. Winds are considered “damaging” when they reach or surpass speeds of 50 to 60 mph, no matter what their origin. If you live in South Florida,  where the waters are warmest, you have a higher chance of being impacted by heavy winds than residents in other parts of the state, especially if you live on either coast.

As a matter of fact, approximately 40 percent of all hurricanes that hit the East Coast of the U.S. will impact our state. Also, more than half of the hurricanes that make landfall in Florida are accompanied by one or more tornadoes.

Most Wind Damage in Florida Is Due to Hurricanes

During hurricane season, which begins June 1st and lasts until November 30th, peaking in September, a great many South Floridians suffer wind damage to their homes and property.

Categorized from 1 to 5 in terms of severity, even a category 1 hurricane with winds between 74 and 95 mph can cause serious damage. A category 5 hurricane, in which winds reach at least 157 mph, is cataclysmic.

Although tornadoes can also cause catastrophic damage, their spiraling winds cover a much narrower area and blow for a far shorter time. While the havoc wrought by a tornado occurs during only 10 minutes or so, a hurricane sustains devastatingly high winds for 24 hours or more, over a much broader area. No matter what type of wind disrupts your life by destroying your home and property, Perez Mayoral, P.A. is determined to bring you the funds you need to reconstruct your home and your lifestyle.

Our Lawyers Know the Most Efficient Way to File a Wind Damage Claim

Because we have filed so many successful wind damage claims, we know the proper strategies to collect the substantial restitution you deserve. We will have the wind damage to your home accurately evaluated and use well-proven strategies to make sure you obtain the resources you need to:

  • Repair or reconstruct all that has broken or collapsed: windows, doors, roof, walls, porch, garage, fences, swimming pools, or other structures
  • Repair or replace furnishings, artwork, equipment, tools, appliances
  • Cover loss of use costs during repairs (e.g. housing, dining out, transportation, etc.)
  • Repair or replace furniture, appliances, electronic devices, toys
  • Repair or replace vehicles: cars, boats, trucks, motorcycles
  • Replace unusable clothing, toiletries, luggage, and other personal property

The Services Your Knowledgeable Wind Damage Attorney Will Provide

During this challenging period, when you no doubt still feel pummeled by winds that have finally subsided, we will handle all the tasks that feel overwhelming, including:

  • Investigating the premises thoroughly, carefully noting needed repairs and replacements
  • Having all of your possessions carefully appraised
  • Coming up with a reasonable, inclusive total claim amount
  • Taking multiple, detailed photos of existing wind damage
  • Handling all negotiations with insurance adjusters and opposing attorneys, even if we have to resort to litigation

We know how traumatic the partial or total loss of your home and property can be and are deeply compassionate. We will take all steps necessary to help you resume life as you know it.

We Know How to Play Hardball with Your Insurance Company

Well aware that insurance adjusters are not working for you, but for their employers, we make sure to look out for your best interests at every turn. We have dealt with all the tricks and calculated maneuvers before, and know exactly how to respond to your insurance company’s attempts to deny your claim by:

  • Stating that your loss is excluded from your policy for a reason stated in small print
  • Saying that the wind damage you sustained falls below your policy’s deductible
  • Maintaining that your claim exaggerates the damage you sustained
  • Claiming that some of the damage sustained pre-existed this storm

Our lawyers know that much of the time, the above are simply tactics to delay payment. Insurance companies work under the premise that the longer they delay, the more likely you are to accept a lower settlement just to receive some of the funds you desperately need.

Contact Our Experienced Wind Damage Attorneys Today

Though your recent trauma may have left you feeling worried and unsure when you get in touch with our law firm you will experience the comfort of renewed stability. Once your insurance company understands that they are dealing with well-respected legal professionals, rather than a homeowner new to the game, they will probably begin reasonable negotiations in earnest. In the meantime, we have a network of contractors and restoration specialists who will help you to begin rebuilding your past and creating a reassuring future. Contact us to schedule your consultation!
