Types of Personal Injury Cases We Handle
Our trial attorneys handle a broad range of personal injury claims, including:
What Happens if I Bear Some Responsibility for My Own Injury?
Suppose you were intoxicated when you fell into an unmarked hole on someone else’s property or were speeding when a driver making an illegal turn hit your car? Different states handle the problem of shared blame for accidents in different ways. Florida works under the principle of pure comparative negligence.
What this means is that in Florida you can still file a claim for damages even if you are partially responsible for the accident. However, the court will assign a percentage of blame to each party and you will only be able to receive damages for the amount awarded minus your percentage of blame. So, if you are awarded $100,000 and the court deems you to be 25 percent responsible for the accident, you will actually receive $75,000. In this context, the word “pure” means that you can sue even if you bear greater responsibility for the accident than the defendant.
Compensation We Will Fight to Obtain for You and Your Family
We know all too well what a difficult period you are going through — medical bills piling up while you are unable to work, looking forward to months of recovery or, possibly, long-term care. We will make every effort to help you obtain substantial compensation for:
- Medical and rehabilitation costs
- Lost income and lost earning power
- Property damage or loss
- Replacement services (e.g. house cleaning)
- Extended nursing care
- Pain and suffering
- Permanent disability
- Permanent scarring or other disfigurements
- Loss of enjoyment of life
- Wrongful death damages (as previously described)
If the defendant’s misconduct was especially egregious behavior, we may also be able to persuade the court to award you punitive damages.
