Michael Mayoral, shareholder at Perez Mayoral, P.A., was featured in a recent NBC Miami segment covering growing concerns from homeowners at the Villas of Sheridan condominium in Hollywood, Florida. The report highlighted allegations of unexplained spending, denied access to records, and questionable payments made by the condo association.
One homeowner interviewed in the piece uncovered a $400 “Merry Christmas” check allegedly tied to a board member’s relative, as well as direct monthly payments to board members and large transfers between association bank accounts. The residents’ concerns were met with silence from the association and limited action from local authorities.
Mayoral, who regularly represents homeowners in disputes against associations, offered legal insight on the segment. He distinguished between board “mismanagement” and criminal “fraud,” stating:
“Mismanagement is anything from poorly analyzing contracts before an HOA gets into them to not responding to maintenance requests from unit owners. Whereas fraud is typically stealing money.”
He advised homeowners in similar situations to:
- Request association records in writing
- Attend board meetings
- Report suspicious activity to the DBPR or local law enforcement
- Consider civil legal action if transparency is denied
