If your condo association fails to repair water damage to your unit, they may be legally responsible for the cost of repairs. Under Florida law, associations are required to maintain the “common elements,” which typically include things like the roof, exterior walls, and shared plumbing. If their failure to maintain these areas leads to water intrusion and damage inside your unit, you have the right to sue the association to recover the money needed to fix your property.
