Partner Fernando Prego Featured in The Real Deal for Sunny Isles Beach Condo Defect Lawsuit
POSTED ON April 9, 2026
Perez Mayoral, P.A. is proud to announce that partner Fernando Prego, Esq. has been featured in The Real Deal, a leading real estate publication, in connection with a high profile condominium construction defect lawsuit in Sunny Isles Beach, Florida.
The article, titled “Trump Group Sued Over Condo Defects in Sunny Isles Beach,” highlights ongoing litigation involving the luxury Estates at Acqualina, a two tower condominium development located at 17901 Collins Avenue.
According to the report, two separate lawsuits have been filed in Miami Dade Circuit Court against the developer, alleging construction defects, delays, and interference with unit ownership.
The development was completed in 2022 but has been tied to a long running dispute with its former general contractor, Suffolk Construction, which the developer terminated in 2023.
Buyers in the lawsuits claim they were unable to fully enjoy their units due to ongoing construction issues, repairs, and access limitations affecting both private residences and shared amenities.
Fernando Prego, Esq., a partner at Perez Mayoral, P.A., is representing an entity that purchased a 5,000 square foot condominium unit for approximately $10.6 million at the property.
The lawsuit alleges that the unit was incomplete and inadequate at closing, including issues such as a malfunctioning elevator system and the inability to access certain private areas of the property.
The complaint further claims that portions of the unit, specifically a terrace and private pool, were used by contractors for an extended period, limiting the owner’s use of the property.
As quoted in the article, Mr. Prego stated:
“His client remains committed to resolving this matter efficiently but will pursue all available remedies to hold the developer accountable and protect its property rights.”
This case reflects a broader trend across South Florida, where condominium owners are increasingly pursuing legal action related to construction defects, delayed project completion, incomplete or substandard unit delivery, loss of use of amenities and private property, and financial damages tied to property conditions.
Luxury developments, in particular, have faced increased scrutiny as buyers expect high construction standards and timely delivery consistent with purchase agreements.
