Presuit Mediation Is Often Required
Owners sometimes read mediation as a delay the association imposed on them. It is usually a statutory requirement. Section 720.311 of the Florida Statutes provides that disputes between an association and a parcel owner over use of or changes to the parcel or the common areas, covenant enforcement, amendments to the association documents, board and committee meetings, membership meetings, and access to official records must be the subject of a demand for presuit mediation before the dispute is filed in court.
The statute also carves out what does not go through that process, including collection of any assessment, fine, or other financial obligation, and any action to enforce a prior mediation settlement agreement.
Why the First Session Rarely Settles
Boards arrive at presuit mediation with counsel who has not yet seen an engineering report, a claim file, or a defensible damage number. There is nothing there to value. The association’s carrier may not be involved at all. The owner’s own scope is often still an estimate rather than a document that would survive scrutiny.
An impasse in that setting says very little about the merits. It says the parties met before either of them was ready to talk about money. Association counsel is also limited by what the board has authorized, and boards rarely authorize a meaningful number before a report exists.
What Changes After Impasse

- Association records fixing the date the board learned of it
- Deposition testimony from board members and the property manager
- A line-item repair scope that holds up under cross-examination

Boards settle when a number becomes defensible. That rarely happens before discovery has produced one.
The Tolling Provision Buys Room
The same section provides that serving a demand for presuit mediation, or filing a petition for arbitration, tolls the applicable statute of limitations. Owners frequently rush into a weak settlement out of a belief that the clock is running against them throughout the process. That fear is what produces the settlements owners regret two years later.
The statute also allows a party facing an emergency to move for temporary injunctive relief without first completing presuit mediation.
